‘Escape? Now you can’ - Terms & Conditions


Highland Spring Limited’s ‘Escape to the country? Now You Can’ photo entry prize draw (“Competition”) for the use of the Highland Spring Holiday Home provided by Trossachs Tiny House (the “Property”) as a holiday home for one calendar year (“Prize”) for one winner (“Winner”) of the Competition and subject to these terms and conditions.


The 'Promoter' is Highland Spring Limited, a company incorporated in Scotland with company number SC067339 having its registered office at Stirling Street, Blackford, Perthshire, PH4 1QA.


The rules of the Competition comprise of these terms and conditions and any entry instructions given by the Promoter in related promotional materials.


Subject to the remainder of this paragraph, the Competition is open to individuals who are resident in Great Britain, at least 18 years old at the time of entry, and have a valid e-mail address connected to the social profile used to enter. The Competition is not open to: (a) businesses; (b) employees, agents and/or representatives of the Promoter, their immediate family/household members (spouse/partner, parents, siblings and children); or (c) anyone professionally connected to the Competition. In entering the Competition, entrants confirm that they are eligible to do so and eligible to claim the Prize they may win. The Promoter may require entrants to provide proof of eligibility to enter the Competition.

The Promoter will not accept Competition entries that are automatically generated by a computer or completed by third parties or in bulk.

Entry Period

The Competition will run from 00:00 (GMT) on 15.07.21 (“Opening Date”) to 23.59 (GMT) on 12.08.21 (“Closing Date”). All Competition entries must be received by the Promoter after the Opening Date and before the Closing Date. All entries received before the Opening Date or after the Closing Date will be not be entered.

Entry Process

To enter the Competition, people must:

  • follow Highland Spring on Instagram or Facebook; and
  • share a photograph of the new flavoured Highland Spring sparkling water cans (any flavour, individual can or four-pack) in an outdoor natural setting on their Instagram grid or Facebook page, tagging @highland_spring and adding the Competition hashtag #HighlandSpringHoliday.

Each entry that satisfies the requirements will be entered into a photo entry raffle, from which one Winner will be drawn at random using an online randomiser on 13.08.21. Entrants will be deemed to have accepted the Rules and agreed to be bound by them when entering the Competition.

The Promoter will not accept responsibility for Competition entries that are lost or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or proof of posting or transmission as proof of receipt of entry to the Competition.

No Purchase Necessary

No purchase is necessary to enter the Competition.

No Multiple Entries

Only one entry per individual for the Competition is allowed.


The Winner will receive the use of the Property starting from 30 August 2021 for one calendar year ending on 29 August 2022 (“Period”) to use as a holiday home in accordance with the Rules.

The Property will be in a permanent location for the Period, within the grounds of the Monachyle Mhor Hotel, Balquhidder, Scotland.

Prize terms

The commencement of the Period and the end of the Period will not be delayed or extended due to any restrictions / issues (travel or otherwise) related to COVID-19.

The Winner will be able to stay in the Property for up to 14 days every calendar month during the Period.

The Winner must vacate the Property for at least 7 days between visits to allow for housekeeping service and any required upkeep to the Property.

The Winner must be present at all visits to the Property, with maximum occupancy as two persons. The Winner is permitted to bring one dog to the property during their stay. Following the Winner’s first stay at the Property, no overnight stays by any other individuals other than the named Winner and a plus one are permitted during the Period.

The Winner will be provided with a central contact with whom they must book their visits at the Property in advance by giving at least 7 days’ notice.

The Winner’s visits to the Property will be covered by additional terms and conditions of the Monachyle Mhor Hotel and/or the owner of the Property. The Winner must comply with such terms and conditions, including where relevant being responsible for damage to the Property caused by the Winner and/or their guests. The Promoter will not be responsible for any damages to the Property, except to the extent directly caused by an employee of the Promoter.

The prize for winning the Competition will be the access to the Property and its facilities as set out in these Rules, for up to 14 days per month for the Period. The facilities include a fully equipped kitchenette with gas cooker, crockery, utensils, kettle, and cooking equipment, full bathroom (rainfall shower, toilet and sink), towels, sitting area with soft furnishings, curtains and blinds, lighting, decoration, clock, double bed on mezzanine, bedding, running water (hot and cold), plumbing, electricity and plug sockets, wood burner and wood, outdoor deck, herb garden, fire pit, housekeeping services (cleaning, bedding changes and waste management after each visit), recycling facilities, fridge stocked with Highland Spring products, and a parking space.

The Winner must dispose of waste and recycling using the facilities provided.

The Prize does not include anything not specifically stated within the Rules as being included. In particular, the Prize does not include travel insurance, the costs of travel, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the Prize are the responsibility of the Winner. The Winner will be responsible for ensuring that they and any person travelling with them are available to travel on the dates booked.

Winner Notification

The Winner will be notified on 13.08.21 through the Instagram or Facebook account used to enter the Competition and must respond via Instagram or Facebook (as the case may be) to claim the Prize within 48 hours of the date and time of the Promoter’s message. If the Winner does not respond to claim the Prize within this period, the Winner will forfeit the Prize and a new Winner will be selected from the remaining entries for the Competition.

Proof of Age

Proof of name, age and address will be required to claim the Prize. If proof satisfactory to the Promoter is not provided to the Promoter within 72 hours of request, the Winner will forfeit the Prize and a new Winner will be selected from the remaining entries for the Competition.


The Prize is non-transferable and there is no cash alternative. The Prize must be taken as stated and no compensation will be payable if a Winner is unable to use the Prize as stated. Winners should allow up to 7 days for confirmation of the Prize, following their proof of name, age and address being confirmed.

Change of Circumstances

In the case of events beyond the Promoter’s reasonable control or unforeseen circumstances, the Promoter reserves the right to withdraw or amend the Competition, alter dates or to substitute the Prize for an alternative of equal or greater value. The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition in whole or in part at any time where it becomes necessary to do so.

Verification of Entries

The Promoter may monitor submitted entries to ensure that they comply with the Rules. The Promoter reserves the right to verify all entries including but not limited to asking for home address, identity details and proof of age and to refuse to award a Prize or withdraw prize entitlement and/ or refuse further participation in the Competition and disqualify the entrant where there are reasonable grounds to believe there has been a breach of the Rules.

Disqualification of Entries

Incomplete or illegible entries, or by or via third parties and entries which do not satisfy the requirements of the Rules in full will be disqualified and will not be counted. The Promoter reserves the right to disqualify any entrant whose conduct is contrary to the spirit or intention of the Competition, including (without limitation) where they have won using deception or fraudulent means.


In the event of any dispute, the decision of the Promoter is final. No correspondence or discussion will be entered into.

The Promoter shall either publish or make available on request information that indicates a valid award of the Prize took place. To comply with this obligation the Promoter will publish or make available the first name or surname and county of the Winner and their winning entry to anyone who emails highlandspring@johndoehub.com or writes to “Highland Spring Holiday Home Competition, 48/4 Albion Street, Glasgow, G1 1LH” enclosing a self-addressed envelope within one month after the Closing Date. If the Winner objects to any or all of their details (first or surname, county and/or winning entry) being published or made available, they must contact the Promoter at highlandspring@johndoehub.com or 0141 648 9610. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

The Promoter and the Winner may agree that the Winner will participate in related publicity with no further recompense.

Ownership of Competition Entries and Intellectual Property Rights

By submitting Competition entries and any accompanying material:

  • entrants agree to: (a) assign to the Promoter all their intellectual property rights; and (b) waive all moral rights, in and to their Competition entry and otherwise in connection with their entry which the entrants may now or in the future be entitled to under the Copyright, Designs and Patents Act 1988.
  • entrants confirm that: (a) the photos are original works, are not defamatory and do not infringe third-party rights; (b) there are no conflicting agreements in place that restrict usage of these photos; (c) they have consent to use any third party image and rights have been waived for that use; (d) if a third party image is of a person under 18, parental or guardian consent has been obtained; (e) they grant an irrevocable, royalty-free, worldwide licence for the full term of copyright to use, alter, adapt or sub-licence rights in the images to third parties.

Data Protection

The Promoter will only process personal information from entrants for the purposes of administering the Competition and fulfilling the Prize, except that the Promoter may also use the entries in promotional material for the Competition and future marketing purposes and any such use by the Promoter shall be in accordance with its privacy policy, which can be found at: [ ].

The Promoter may publicise information about the Winner as mentioned at ‘Publicity’ above.

The Promoter will use and retain any such personal information in accordance with its privacy policy which can be found at http://highlandspring.com/privacy-policy/.

No Affiliation

The Competition is being run by the Promoter, and neither Instagram nor Facebook has any responsibility or liability for the Competition.

Applicable Law

The Competition will be governed by the laws of Scotland and any disputes will be subject to the jurisdiction of the courts of Scotland.


In the event of an entrant’s Instagram or Facebook account changing or the Instagram or Facebook account being lost, stolen or removed, the Promoter is not able to retrieve and amend any existing entries to a new account.

The Winner will be the owner of the Instagram or Facebook account that the entry has been sent from. No other individual is eligible to claim the Prize.

The Promoter accepts no responsibility for the Prize being delayed or is unable to be awarded for any reason beyond its control.

To the extent permitted by law, the Promoter shall have no liability for: (a) technical problems of any kind which may limit or prevent participation in the Competition; (b) any damage to, or viruses that may be transmitted to or infect, computer equipment as a result of participation in the Competition; (c) any injury, loss or damage arising directly or indirectly from or in connection with the receipt, use or allocation of the Prize; or (d) any other events beyond the Promoter’s reasonable control that may cause the Competition to be cancelled, modified, disrupted or corrupted or may lead to loss, delay or damage of the Prize. If, for any reason beyond the control of the Promoter, the Competition is not capable of running as planned, then the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition. In such event, the Promoter may, at its sole discretion, select the Winner from among all eligible entries received prior to or after such cancellation, suspension, or modification.
